Mailsac is a service of Forking Software LLC.

1. Preamble

1a. This Privacy Policy discloses the privacy practices for the Mailsac service by Forking Software LLC (mailsac.com, associated sites, and backend or frontend internet services that support the mailsac.com website).

1b. This Privacy Policy applies to information collected by Mailsac. It will educate the user of the following:

  • 1b-i. What personally identifiable information is collected from you through the web site, how it is used and with whom it may be shared.

  • 1b-ii. What choices are available to you regarding the use of your data.

  • 1b-iii. The security procedures in place to protect the misuse of your information.

  • 1b-iv. How you can correct any inaccuracies in the information.

2. Email

This site provides public (non-private) email, and public or private email testing services. Email inboxes that are not purchased (AKA private) are public and have no privacy expectation. Email inboxes and custom domains which are marked “public” by the user also have no expectation of privacy. Enhanced addresses which are “released” or “deleted” or for which the account loses good standing (such as due to a past-due subscription), may become non-private again.

Consider this warning carefully when you opt to receive email on this website and give out addresses that will have email delivered to this website. Email is PUBLICLY VIEWABLE CONTENT unless otherwise explicitly indicated. On private email, we reserve the right to inspect or share information contained in those emails, but it REASONABLY EXPECTED that mail termed “private” will not be made viewable to the public at large or to any third party. However it MAY BE MADE PUBLIC due to lack of payment or lapsed accounts, and it MAY BE MADE AVAILBLE to third parties in the case of: 1. fraud complaints, in which case Mailsac may share data upstream to the verified entity complaining of fraud 2. cybersecurity incident requests related to fraud from entities deemed reliably verified by the Mailsac team 3. requests from government agencies based in the United States of America

In the case of information sharing, Mailsac will attempt to notify the account holder via email, if mail can be determined to be linked to an account. Mailsac will not notify the account holder if a government agency requests otherwise.

3. Information Collection, Use, and Sharing

3a. We are the sole owners of the information collected on this site, email received to PUBLIC email addresses on this site, email TURNED PUBLIC due to released private email addresses or domains or unpaid accounts, and ALL derived/aggregated analytics about email or usage on the website. We will not sell the private email contents to third parties (such as email in private reserved addresses, custom domain email, or records linking an account or IP address to an email address or custom domain).

3b. We will use your information to respond to you regarding the reason you contacted us.

3c. Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.

3d. Mailsac has no advertisements or advertisement tracking. Mailsac does not sell any information to advertisers.

3e. We may disclose your information in the following ways:

  1. Public inboxes: Public inboxes and their contents are public. When you send email to public inboxes this information is public in nature. This data is accessible to anyone, including third parties. This data may be collected, used, or disclosed by other users of our service. This data may be collected and sold to third parties.

  2. Service providers: We may disclose information to our service providers (e.g., infrastructure as a service, payment processing, and customer support services), pursuant to written agreements with confidentiality, privacy, and security obligations.

  3. Online Forums: When you take certain actions on our forums that are public in nature, this information may be collected, used, or disclosed by other users of the forums.

  4. Compliance and Safety: We may disclose information to law enforcement or other third parties when we determine such disclosure is necessary to comply with legal obligations or to protect our interests or safety, the interests or safety of our customers or others, or to prevent illegal behavior or to otherwise protect our legal rights. We may also disclose information to law enforcement or other third parties when we have a good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process.

  5. Merger or Acquisition: We may disclose information to a third party who acquires or may acquire any or all of our business units, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets, or bankruptcy.

  6. With Your Consent: We may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent.

3f. Sub-processors

The definition of a sub-processor under GDPR is a third-party data processor engaged by Mailsac, who has or potentially will have access to or process service data (which may contain Personal Data). Mailsac engages different types of sub-processors to perform various functions as explained in the tables below.

4. Your Access To and Control Over Information

You may opt out of specials and new products of features from us.

Mailsac will send account holders system notifications via email which directly affect your service, your subscriptions, billing and payment requests, and new services ordered by you. We may not allow you to opt-out of these notifications, due to security and billing implications if the notifications were not sent.

You can do the following at any time by contacting us via the support email given on our website:

  • See what data we have about you, if any.

  • Change/correct any data we have about you.

  • Have us delete any data we have about you.

  • Express any concern you have about our use of your data.

5. Registration

5a. In order to gain FULL USE of Mailsac, user registration IS REQUIRED.

5b. Partial use of Mailsac is possible without user registration, in which case information such as, but not limited to, IP address, geographic information, or cookies may be used to identify the user or throttle their usage of the website.

5c. During registration a user is required to give certain information. This information may be used to contact you about the products/services. It may be shared with 3rd parties as described throughout this privacy policy, but it will not be sold or shared with advertisers.

6. Orders

We request information from you on our order and checkout forms via third party.

To buy services from us, you may need provide contact information and financial information, including to third parties (payment processors and other business partners). This information is used for billing purposes and to provide you service. It is stored with the payment processor and not on this site. If we have trouble processing an order, we’ll use this information to contact you. We may share this information with third parties to ensure payment and provide targeted and improved services.

7. Cookies

We use cookies on this site. A cookie is a piece of data stored on a site visitor’s device to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our site.

Cookies can also enable us to track and target the interests of our users to enhance the experience on our site.

Mailsac does not have third party advertisements, nor third party advertiser cookies. Mailsac does collect usage information on our site to provide a better experience and prevent fraud, and leverages third parties for this purpose:

  • Zendesk

  • Plausible Analytics

  • Stripe

11. Surveys and Contests

From time-to-time our site requests information via surveys or contests.

Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.

12. Security

12a. We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Our goal is to use encryption while information is in transit and at rest, but there are exceptions and data may be transmitted or stored without encryption. For a more specific agreement, please purchase an Enterprise license.

12b. Stripe is a third party which securely processes financial data. The privacy policy is found on their website, https://www.stripe.com. Mailsac is NOT P.C.I. COMPLIANT and relies on Stripe for handling credit card information.

12c. We protect your information offline. Only workers who need the information to perform a specific job (for example, billing, troubleshooting team or customer service) are granted access to personally identifiable information, or if requested by law enforcement, or in the event of a customer security issue we may give limited information to help the customer troubleshoot, which may include IP addresses, inbound email addresses, domains, and user account or username information (but not password hashes) for other customers or users of the service who appear to have performed acts intended to cause harm to another customer. Workers may or may not be employees of Mailsac.

12d. The computers/servers in which we store personally identifiable information are kept in a secure environment. Mailsac relies on third party virtual server providers. Below is a non-exhaustive list of server providers which may be used by Mailsac. For a current list, contact support@team.mailsac.com.

Hosting provider workers may have privileged access to Mailsac servers.

12e. From time to time we may run general analytics to determine usage statistics.

12f. We track analytics on 1) inbound email, 2) outbound email, and 3) API or website usage. Inbound and outbound mail information and analytics, when mail was unpaid and public, may be provided as a feature for customers to consume.

12g. Mailsac team members may inspect analytics on a specific account for the purpose of detecting fraud.

13. Updates

This Privacy Policy may change from time to time and all updates will be posted on this website. The user is expected to check back here for updates, and we reserve the right to NOT NOTIFY the user via email when this Privacy Policy changes.

If you feel that we are not abiding by this privacy policy, you should contact us via support@team.mailsac.com.

14. Altering this Policy

14a. If you have other privacy concerns, or are interested in an alternative privacy arrangement (such as an enterprise), please contact support@team.mailsac.com to purchase a different arrangement. This Privacy Policy may be superseded by an alternative agreement acquired by working with Mailsac Sales and Support via obtaining a signed agreement.

14b. WE RECOMMEND USERS REGULARLY REVIEW THIS PRIVACY POLICY SINCE IT MAY CHANGE WITHOUT NOTICE.
